TERMS & CONDITIONS
AUTHORITY OF MEDIA OWNERSHIP
The customer
authorizes ReWave Data Recovery, LLC (“ReWave”)
to perform
an evaluation of the media to determine the extent of
damage and provide
a recovery proposal/estimate. This evaluation is free and no work
will be performed
after the evaluation without approval from the client. By sending
this media (hard
drive or other)
to ReWave, I attest to the fact that I am the legal
owner/authorized representative of
the media and the
data/information contained on it. The client
agrees to reimburse ReWave for any claims against ReWave related to
the data
recovery effort, in the
event that you are not the legal
owner/authorized representative
of the data.
LIABILITY WAIVER
By sending this media (hard drive(s)
or other) to ReWave, I understand that my data
may not be recoverable. I understand that the process(es) ReWave
performs may
result in loss of part or all of the data. ReWave Data Recovery, LLC does not
make any guarantee to the
success of our data recovery. I agree not to hold ReWave liable for any such data loss, which may
occur during or
as a result of our processes.
I also agree not to hold ReWave
responsible for loss
due to theft, shipping, etc in connection with this waiver. The
limit of ReWave’s responsibility will be a maximum
of the cost for
replacing the media (not the data/information on the media).
CONFIDENTIALITY AGREEMENT / NON-DISCLOSURE
ReWave understands that the data
contained on your media is confidential. ReWave operates on an
unwritten Non-Disclosure Agreement. If you have a Non-Disclosure
Agreement you would like for us to sign, please send it along with
your media or fax
in advance. ReWave agrees not to disclose any information from the
media to anyone except employees or agents of ReWave subject to
confidentiality agreements or as required by law.
WARRANTY OF SERVICES
ReWave makes no warranty, express or
implied for the services being provided (before, during or after
service is performed).
LEGAL RIGHTS
Any media/property left with ReWave
over 30 days will be disposed of. Other Legal
Notices listed on ReWave website are agreed to/upon.
PAYMENT OF SERVICES
Payment for services is due in full
upon completion of successful recovery and must
be paid to ReWave in advance of data being released to customer. If
the recovery
efforts are unsuccessful, there will be no charge to the customer.
ReWave accepts:
Visa, MasterCard, American Express, Discover, Money Order, Company
Checks, Cashier’s Checks and PayPal.
